Stewarts Law’s Clive Zietman has written in The Times Law section about the differences between the US system of securities litigation and how the UK system differs in light of the RBS case.
Zietman said: “In his article, Ned Beale suggests that US-style securities litigation is heading this way in the wake of the RBS case. This is some way off the mark. It is true that restrictions on foreign claims in the US courts are forcing institutional investors to look afresh at the subject of shareholder litigation in other jurisdictions. We are unlikely, however, to see a huge swathe of such cases here anytime soon, for a number of important reasons.”
